Trek Nectar / Culture Co-Op: Event and Experience Participation Agreement

Acceptance of Terms

By registering for, participating in, or attending any program, retreat, workshop, class, or event offered by Trek Nectar LLC or the Culture Co-Op (collectively, "the Activities"), you ("Attendee") agree to be bound by these terms and conditions. The Waiver of Liability & Release can be found below.

Program Information and Registration

Details of specific Activities (dates, locations, inclusions, exclusions, pricing) will be provided at the time of registration. Registration applications and deposits for retreats are nonrefundable.

Cancellations and Refunds

Full refunds are only accommodated if canceled 90 days prior to the program start date.50% refunds are only accommodated if canceled between 90-30 days prior to the program start date. No refund is available if cancellation occurs within 30 days of the program start date, for no-shows, or early departure. Serious, extenuating circumstances will be handled on a case-by-case basis. All cancellations must be submitted in writing via email to support@treknectar.com. *

Trek Nectar / Culture Co-Op Cancellations

Trek Nectar LLC reserves the right to cancel or reschedule any program at any time due to unforeseen circumstances. * In such event, Attendees will receive a complete refund or credit toward a rescheduled or future program. * If a natural disaster or other event causes a program to be moved or changed, adequate substitutions will be provided, and no refunds will be given if the Attendee chooses not to attend or leaves early.

Changing Programs

Attendees may change enrollment to another Trek Nectar program, with credit rolled over. A $44 change fee applies for changes made 90 days or less prior to an Adventure Retreat. The new program must be chosen on the date of change and must occur within two years of the change date.

Health and Participation Acknowledgement

Attendee recognizes and warrants that they are in good physical and mental health and have no medical condition preventing full participation in the Activities. Attendee has consulted with a physician regarding participation, if necessary. Attendee is aware that Activities may involve physical exertion and potential risks (e.g., abnormal blood pressure, fainting, heartbeat disorders, physical injury, heart attack, muscle/back/bone injuries). Attendee understands their physical limitations and will stop physical activity before becoming ill or injured. Attendee has a continuing responsibility to inform Trek Nectar and Culture Co-Op members of any previous medical conditions, injuries, or surgeries. Trek Nectar LLC reserves the right to refuse participation on medical or fitness grounds.

Photo and Video Release

Attendee consents to the use of their image in photographs or videos taken during classes or events, for placement on Trek Nectar's website or affiliated websites

General Provisions

Trek Nectar LLC reserves the right to change this agreement.

Passports and Visas

A valid passport is required for international programs with Trek Nectar Adventure Retreats or Culture Co-Op programs. Attendees are responsible for checking country entry requirements, including visas and medical documentation. Any travel-related questions may be sent to support@treknectar.com.

Travel Insurance

Travel Insurance is highly recommended to protect your investment.

Waiver of Liability and Release

Attendee agrees to assume full responsibility for any risks, injuries, or damages, known or unknown, incurred as a result of participating in the Activities. Attendee knowingly, voluntarily, and expressly waives any "Claims" (including liabilities, demands, expenses, legal actions, damages for personal injury, mental suffering, distress, or death) against Trek Nectar LLC or the Culture Co-Op, its owners, members, employees, instructors, teachers, workshop presenters, and independent contractors (each a "Released Party"). This waiver applies to Claims caused by any negligence or other acts of a Released Party, except to the extent that such death, personal injury, or illness arises from any negligent act or omission of Trek Nectar LLC or its owners, members, employees, and/or instructors, or teachers. Attendee, their heirs or legal representatives, forever release, waive, discharge, and covenant not to sue any Released Party.

* Attendee acknowledges having carefully read and fully understood this release and waiver, and is giving up substantial rights, including the right to sue.

I am participating in yoga classes, health programs, hikes, workshops and other exercises and other activities (collectively, the “Activities”) offered by Trek Nectar LLC/Culture Co-Op and/or its owners, members, instructors, teachers, workshop presenters, and independent contractors.
I recognize that I must be in good physical and mental health to participate in the Activities. I understand that the Activities require physical exertion and I represent and warrant that I am physically fit and I have no medical condition which would prevent my full participation. I understand that it is my responsibility to consult with a physician prior to and regarding my participation. If I have consulted a physician, I have taken the physician’s advice. I understand that Trek Nectar LLC reserves the right in it's absolute discretion to refuse my participation in an Activity on medical or fitness grounds.
I am in proper physical condition to participate in the Activities, and I am aware that participation could, in some circumstances, result in abnormal blood pressure, fainting, heartbeat disorders, physical injury and potentially heart attack. I also understand that I could experience muscle, back, or bone injuries during exercise. I understand my physical limitations and am sufficiently self-aware to stop physical activity before I become ill or injured. I understand that it is my continuing responsibility to inform the teachers or employees at Trek Nectar LLC of any previous medical conditions, injuries or surgeries prior to my first class and any future changes to my medical condition.
In consideration of being permitted to participate in the Activities, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the Activities.
In further consideration of being permitted to participate in the Activities, I knowingly, voluntarily and expressly waive any “Claims” (as defined below) I may have against Trek Nectar LLC, its owners, members, employees, and/or its instructors, and teachers, for any Claim that I may sustain as a result of participating in the Activities. Trek Nectar LLC and each such person or entity is each referred to as a "Released Party". “Claims” include but are not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental suffering and distress, or death that I may suffer, my children may suffer or that my unborn child may suffer (including any legal fees or expenses) in connection with participation in any Activity.
Neither Trek Nectar LLC nor its owners, members, employees and/or instructors, or teachers shall be liable for any death, personal injury or illness occurring during participation in the Activities, except to the extent that such death, personal injury or illness arises from any negligent act or omission of Trek Nectar LLC or its owners, members, employees and/or instructors, or teachers.
I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue any Released Party for any Claim caused by any negligence or other acts of Trek Nectar LLC.
I hereby understand that Trek Nectar LLC from time to time may photograph or video classes or events occurring at its Studios and place such photographs and videos on its Website. I hereby consent to the use of my image that may appear in any such photograph or video. “Website” means www.treknectar.com or affiliated websites. "Studio" means any venue used by Trek Nectar LLC or affiliated with Trek Nectar LLC from time to time.

I acknowledge that I have carefully read this release and waiver of liability and fully understand its contents. I voluntarily and knowingly agree to the terms and conditions stated herein. I am aware that by signing this release and waiver of liability, I am giving up substantial rights, including my right to sue and certain legal rights my heirs, next of kin, executors, administrators and assigns may have against any Released Party.
